Hey Krishna Terms of Service

The short version

• What Hey Krishna is: a Krishna-guided AI spiritual companion intended to provide voice, chat, journaling, and related reflective experiences.
• What it is not: it is not a deity, religious authority, therapist, doctor, lawyer, financial adviser, or emergency service.
• Your responsibility: use the Service lawfully, protect your account, and seek qualified professional or emergency help when needed.
• Payments: paid features are not currently enabled. If enabled, prices and purchase terms will be shown before payment.
• Your content: you retain ownership of what you submit. You allow us to process it only as needed to provide and operate the Service.
• Disputes: Indian law applies, and courts in Hyderabad, Telangana have jurisdiction, subject to applicable law.

1. Who we are and acceptance of these Terms

Hey Krishna is developed and operated by NETRAYUG LABS PRIVATE LIMITED (“Netrayug”, “Hey Krishna”, “we”, “us”, or “our”).

These Terms of Service (“Terms”) govern your access to and use of the Hey Krishna website, mobile applications when made available, and related services (collectively, the “Service”). By creating an account, accessing, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. What the Service is

Hey Krishna is an AI spiritual companion inspired by Krishna and the Bhagavad Gita tradition. It is intended to provide a warm, devotional experience through features such as voice conversations, chat, journaling, reminders, and personalized reflections. Features and platform availability may change over time.

When you interact with “Krishna” in the Service, you are interacting with an AI system that generates responses. The Service is not a deity, divine manifestation, ordained institution, or religious authority, and we make no claim of divine authority for its responses.

3. Important limits and emergency situations

The Service is not a licensed therapist, counsellor, psychologist, doctor, medical professional, lawyer, financial or investment adviser, or emergency service. Its responses are not professional advice, diagnosis, treatment, or an authoritative religious ruling.

Do not disregard professional advice or delay seeking it because of something generated by the Service. AI responses may be incomplete, inaccurate, or unsuitable for your circumstances.

If you may harm yourself or another person, or you are otherwise in immediate danger, do not rely on the Service. Contact local emergency services. In India, call 112. Other resources may include iCALL at 9152987821, AASRA at 9820466726, and Child Helpline at 1098.

4. Eligibility and accounts

The Service is intended for people aged 13 or older. A higher minimum age or verifiable parental or guardian consent may apply under the law where you live. If you are under 18 in India, use of features that process personal data may require verifiable consent from a parent or lawful guardian under applicable law.

You agree to provide accurate account information, maintain the security of your sign-in credentials, and accept responsibility for activity under your account. Tell us promptly at support@heykrishna.app if you believe your account has been accessed without permission.

5. Acceptable use

You agree not to:

• use the Service unlawfully or to harm, threaten, exploit, or harass another person;
• submit content that infringes intellectual-property, privacy, or other rights;
• attempt to extract, reverse-engineer, reveal, or copy models, prompts, system instructions, source code, or security mechanisms;
• probe, overload, disrupt, bypass, or gain unauthorized access to the Service or related systems;
• use bots, scraping, or automated access except where we have expressly permitted it;
• impersonate another person or misrepresent your affiliation;
• introduce malware or other harmful code; or
• resell, sublicense, or commercially exploit the Service without written permission.

We may investigate suspected misuse and may limit or terminate access when reasonably necessary to protect users, the Service, or comply with law.

6. Payments, subscriptions, and refunds

Paid features are not currently enabled.

If paid features are enabled, the planned offering may include an ₹11 introductory trial, a ₹299 monthly subscription, and minutes top-up packs. The final price, taxes, billing period, included benefits, renewal terms, and cancellation information displayed at the point of purchase will control. We may change or discontinue an offering before purchase or renewal as permitted by law.

Payments may be processed by Apple, Google, and/or Razorpay. Their terms may also apply. Refunds and cancellations will be handled under the purchase terms shown to you, the applicable payment provider’s rules, and applicable law. We do not store complete payment-card details processed by those providers.

A person under 18 must have permission from a parent or guardian before making a purchase.

7. Your content and privacy

You retain ownership of content you submit, including messages, voice inputs, transcripts, and journal entries.

You grant us a limited, worldwide license to host, store, reproduce, transcribe, process, and use that content only as reasonably necessary to provide, secure, personalize, support, and improve the Service as described in our Privacy Policy. This license ends when the content is deleted, except for limited backup, security, and legally required retention described in the Privacy Policy.

You represent that you have the rights needed to submit your content and that our processing of it as described in these Terms will not violate another person’s rights.

Our Privacy Policy explains what information we collect, how providers process it, and how to request access, correction, or deletion.

8. Our intellectual property

The Service, software, designs, branding, content supplied by us, AI configuration, prompts, and related intellectual property are owned by Netrayug or its licensors. These Terms grant you only a limited, personal, non-exclusive, non-transferable, revocable right to use the Service in accordance with these Terms.

You may not copy, modify, distribute, sell, license, or create derivative works from the Service except where applicable law expressly permits it.

9. Third-party services

The Service relies on third-party platforms and providers for functions such as authentication, hosting, AI processing, speech, voice, calling, notifications, storage, and future payments. Their services may occasionally be unavailable or subject to separate terms. We are not responsible for third-party services outside our reasonable control, but this does not affect responsibilities that cannot be excluded under applicable law.

10. Suspension, termination, and deletion

You may stop using the Service and request account deletion at any time as described in the Privacy Policy.

We may suspend or terminate access if you materially violate these Terms, create risk or harm, misuse the Service, or if suspension is required by law or a platform provider. Where reasonable, we will provide notice and an opportunity to address the issue.

Provisions concerning ownership, disclaimers, liability, disputes, and obligations that by their nature should survive will continue after termination.

11. Disclaimers

The Service is provided “as is” and “as available” to the fullest extent permitted by law. We do not guarantee uninterrupted availability or that AI responses will always be accurate, complete, current, safe, or suitable for your circumstances.

To the fullest extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Nothing in these Terms excludes warranties or consumer rights that cannot lawfully be excluded.

12. Limitation of liability

To the fullest extent permitted by law, Netrayug and its directors, employees, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, goodwill, or data, arising from or related to the Service.

To the fullest extent permitted by law, our aggregate liability for claims arising from or related to the Service will not exceed the amount you paid for the Service during the 12 months immediately before the event giving rise to the claim.

Nothing in these Terms limits liability or legal rights that cannot be limited under applicable law.

13. Indemnity

To the extent permitted by law, you agree to indemnify Netrayug against third-party claims, losses, and reasonable costs arising from your unlawful use of the Service, your material violation of these Terms, or content you submit that infringes another person’s rights. This section does not apply where the claim results from our own unlawful conduct.

14. Governing law and disputes

These Terms are governed by the laws of India. Subject to applicable consumer-protection and other mandatory laws, the courts in Hyderabad, Telangana, India will have exclusive jurisdiction over disputes arising from or relating to these Terms or the Service.

Before starting court proceedings, you may contact support@heykrishna.app so we can attempt to resolve the issue directly. This does not prevent either party from seeking urgent or injunctive relief where available.

15. Changes to the Service or these Terms

We may modify the Service and update these Terms. If a change materially affects your rights, we will provide notice through the Service, by email, or by another appropriate method before it takes effect where required. The date at the top identifies the current version.

If you continue using the Service after updated Terms take effect, you accept the updated Terms. If you do not agree, stop using the Service and request account deletion.

16. General terms

If a provision of these Terms is held unenforceable, the remaining provisions remain effective. Our failure to enforce a provision is not a waiver. You may not transfer your rights under these Terms without our consent. We may transfer these Terms as part of a merger, reorganization, financing, sale of assets, or similar transaction, subject to applicable law.

These Terms, together with the Privacy Policy and any purchase terms shown to you, form the agreement between you and us concerning the Service.
